SERVER ENVIRONMENT: LTG utilizes High Performance and High Frequency Virtual Private Servers (LTG Servers) with Linux operating systems and LiteSpeed server side cache. LTG will maintain the environment as needed for our clients. This includes managing environment size, server performance, PHP language version updates, operating systems updates and upgrades, MySql updates and upgrades, and panel software updates. LTG will mitigate any issues that may result from LTG server environment and is included in our hosting services. Items not covered include extended DDOS protection, PCI Compliance scans and/or server remediation, additional PHP extensions and setup, and custom server setups. These items are not included with our standard hosting unless otherwise noted in your agreement or invoicing at an additional charge. Out of an abundance of caution for security and unless otherwise noted, LTG does not provide panel, SSH, FTP or SFTP access to LTG server environment.
HOSTING SIZE: The maximum hosting size for our standard services agreement is up to 5,000 Megabyte or 5 Gigabyte. Unless noted in your agreement, websites that grow above this may incur additional charges.
SECURE SOCKETS LAYER: LTG utilizes SSL’s installed on the LTG server for websites. They are TLS 1.2/1.3 compliant for secure browsing and form fills. LTG utilizes Let’s Encrypt Auto SSL service for the purpose of securing our clients websites and they renew every 90-days. Let’s Encrypt SSL’s are Domain Validated. LTG will be responsible for ensuring proper implementation and updating for the client’s website. SSL’s other than Let’s Encrypt such as Organization Validated or Extended Validated are not included with our standard hosting and must be otherwise noted additionally in your agreement or invoicing at an additional charge.
WEBSITE UPDATES: As part of our standard hosting agreement and at times determined by LTG, we will provide periodic updates for theme, and plugin software to ensure proper continued security. We include weekly backups for static sites and daily backups for membership, ecommerce and non-static websites. LTG will not perform updates to software/plugins added by client after site launch. Plugins that are added by client and have a security vulnerability may be disabled and deleted by LTG.
LICENSES: We include licensing fees for software that is utilized at site launch. This software includes but is not limited to: Themes, Gravity Forms, Elementor Pro, Crocoblock, QI Addons Pro, WooCommerce and related pro plugins, WP-All Import Pro, and more. Licenses provided by LTG are whitelisted to be used on LTG servers ONLY and cannot be transferred to 3rd party hosting services. Client is responsible for software licenses if hosted outside of LTG servers. LTG will not provide licenses for software/plugins added by client after site launch.
SMTP MAILER: LTG utilizes Amazon SES email service to provide a mailing solution for website contact forms. Mail will be sent from contactformrelay.com or ltgformrelay.com. This mailer IS whitelisted to be used on LTG servers and cannot be transferred to 3rd party hosting. Abuse of this system by clients may result in termination of services. Client may at anytime utilize their own SMTP mailer through Port 587 only. Maintaining 3rd party mailers or providing support on them is not covered in our hosting agreement.
VIDEOS: Videos that were included in the original site launch often are streamed from Amazon S3 Bucket. Additional videos added to the site by client post launch are not included but may be added at an additional annual charge. Large videos added to the hosting account by the client that utilizes large Videos consume large bandwidth and charges are normally assessed based on bandwidth usage.
CONTENT UPDATES: LTG can provide website content and design updates upon request. Unless noted in an agreement, updates outside of program and software are not included in our standard hosting. This includes content, images, design, additional software, software changes, and software upgrades. LTG charges a minimum of 1-hour per day for each request and is billed at the hourly rate specified in your agreement.
RECAPTCHA API/MAPS API/CLOUDFRONT CDN: LTG may secure ReCaptcha API, Google Maps API, and Amazon CloudFront CDN as part of the website project. These are connected to Lion Tree Group’s Billing account and cannot be transferred.
3RD PARTY INTEGRATIONS: LTG may integrate and maintain 3rd party connections with Manage WP, Bing Webmaster, Google Search Console, Google Analytics, Google Tag Manager, and Google My Business as part of our hosting agreement. It is the responsibility of the client to ensure proper ownership is acquired or transferred prior to migration or moving of website(s). LTG will work with client upon request at no additional charge to add ownership accounts and access. LTG may terminate these services and connections if site is moved or migrated to third party platforms, unless otherwise noted.
DNS: LTG does not provide domain hosting or DNS hosting services for any of our clients under our agency name and is not included in our hosting agreement. Upon request and if access is given, LTG can provide DNS updates, domain transfers and changes at our standard hourly rate.
RENEWAL DATE: The hosting renewal date will be determined by LTG. If part of a design agreement, it may be listed under item #7 and usually coincides with when the environment was first setup and software purchased for the site development. This normally does not coincide to when the website is launched. If the project development is longer than 1 year and the annual hosting charge comes due, this payment is required to cover the cost of keeping the dev environment updated, providing environment backups, and licensing renewals.
HOSTING INCREASE: Hosting charges may increase as inflation increases. Cost of servers or software licensing may increase over time and will be passed along to the client. LTG shall provide a 30-day notice of any increases to it’s hosting services.
FAILURE TO PAY: Client agrees to have Consultant provide hosting services as outlined and described above and Client agrees to pay an annual hosting fee. Failure to pay the hosting fee and/or other invoices received from the Consultant within 60-calendar days of receiving invoices may result in suspension of hosting services and a $250 reinstatement fee may be accessed to reinstate services.
CANCELLATION OF SERVICES: Client may cancel hosting services at anytime by contacting us or by performing a self migration. Upon request, LTG will provide a zip file of the public_html folder and a copy of the MySQL database in zip format at no additional charge. Hosting services and licenses are paid annually and cannot be refunded either partially or pro-rated. Once site is migrated LTG will cancel all related services, licenses and 3rd party connections. Additional work requested to setup or transfer files to new hosting account will be done on time and material basis.
LIMITED LIABILITY: Consultant makes no warranties, either express or implied, as to any matter whatsoever, including without limitation the condition of the improvements merchantability or fitness for any particular purpose. Customer agrees that in no event will Consultant be liable to Client for any loss of use, loss of business, loss of profit, emotional distress, personal injury, or indirect, incidental, or consequential damages, caused directly or indirectly by the acts or omissions of Consultant under this Agreement.
